Rewatch, Inc, a Delaware corporation (“Rewatch” and “we” / “us”) respects your privacy. This notice describes the types of Personal Data (as defined below) we may collect or that you may provide when you interact with our websites and software (collectively, the “Application”); when you communicate with us, when you seek career opportunities with us, and if you are our customer or a potential customer, and our practices for collecting, using, maintaining, protecting, and disclosing Personal Data. “Usage Data” means information collected automatically through this Application (or third-party services employed in this Application), which can include: the IP addresses or domain names of the computers utilized by the Users who use the Application, the URI addresses (Uniform Resource Identifier), the time of the request, the method utilized to submit the request to the server, the size of the file received in response, the numerical code indicating the status of the server’s answer (successful outcome, error, etc.), the country of origin, the features of the browser and the operating system utilized by the User, the various time details per visit (e.g., the time spent on each page within the Application) and the details about the path followed within the Application with special reference to the sequence of pages visited, and other parameters about the device operating system and/or the User’s IT environment.
“User” means the individual using this Application

Unless specified otherwise, all Data requested by the Application is mandatory and failure to provide the Data may make it impossible for this Application to provide its Services. In cases where the Application specifically states that some Data is not mandatory, Users are free not to provide the Data without consequences to the availability or the functioning of the Application. Despite our efforts to store Personal Data in a secure operating environment that is not available to the public, we cannot guarantee the security of Personal Data during its transmission or its storage on our systems. Further, while we attempt to ensure the integrity and security of Personal Information, we cannot guarantee that our security measures will prevent malicious third-parties from illegally obtaining access to Personal Information. We do not warrant or represent that Personal Information about you will be protected against, loss, misuse, or alteration by third parties.

We may process Personal Data if one of the following applies:

Data Subjects have given their consent for one or more specific purposes; provided, that, in certain jurisdictions (other than the European Union) Rewatch may be allowed to process Personal Data until the Data Subject objects to such processing (“opt-out”), without having to rely on consent or any other of the following legal bases;
Provision of Data is necessary for the performance of an agreement with the Data Subject and/or for any pre-contractual obligations thereof;
Processing is necessary for compliance with a legal obligation to which Rewatch is subject;
Processing is necessary for the purposes of the legitimate interests pursued by Rewatch or by a third party.

X. Transfers of Personal Data

Rewatch is based in the United States of America. If you are located in the European Economic Area (“EEA”), the United Kingdom, or Switzerland, this means that we may transfer Personal Data outside of the EEA, the United Kingdom, or Switzerland. Such transfers are made using adequate safeguards, such as the EU Standard Contractual Clauses for Controller-to-Controller and Controller-to-Processor Transfers.

In the last 12 months, we have not “sold” or “shared” Personal Data as defined in the California Consumer Privacy Act (CCPA). The CCPA defines “selling” as sharing, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating Personal Data to a third party for monetary or other valuable consideration. The CCPA defines “sharing” as sharing, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating Personal Data to a third party for cross-context behavioral advertising (or “targeted advertising”). Consequently, we do not have a Do Not Sell My Info-functionality on the Application.

XII. Retention Time

Personal Data shall be processed and stored for as long as required by the purpose for which it has been collected.

Personal Data collected for purposes related to the performance of a contract between Rewatch and the Data Subject shall be retained until such contract has been fully performed and for a period of up to four years thereafter (or such longer time as is necessary to enforce or protect our interests or as required by law).

Personal Data collected for the purposes of Rewatch’s legitimate interests shall be retained as long as needed to fulfill such purposes. Data Subjects may find specific information regarding the legitimate interests pursued by Rewatch by contacting Rewatch.

Rewatch may be allowed to retain Personal Data for a longer period whenever the Data Subject has given consent to such processing, as long as such consent is not withdrawn. Furthermore, Rewatch may be obligated to retain Personal Data for a longer period whenever required to do so for the performance of a legal obligation or upon order of an authority.

Once the retention period expires, Personal Data shall be deleted. Therefore, the right to access, the right to erasure, the right to rectification and the right to data portability cannot be enforced after expiration of the retention period.

Certain Rights of Data Subjects

Users may have certain rights regarding Personal Information about them processed by Rewatch in particular jurisdictions, depending on whether Rewatch is subject to the jurisdictional reach of the applicable laws, such as:

These requests can be exercised free of charge, except if such requests are excessive and/or repetitive, and will be addressed by Rewatch as early as possible and in any event no later than within 30 calendar days.

Disclosure of Personal Data

We may disclose Data that does not identify any individual without restriction. In addition, we may disclose Personal Data that we collect or you provide:

To our subsidiaries and affiliates. To contractors, service providers (as described above in “Detailed Information Concerning the Processing of Personal Data”), and other third parties we use to support our business solely for purposes of providing such services and for no other purpose.

Your California Privacy Rights

California Civil Code Section 1798.83 permits users of our Application that are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. In the last 12 months, we have not sold Personal Information collected in and through the Application. Consequently, we do not have a Do Not Sell My Info-functionality on the Application.

You have a right not to be treated in a discriminatory manner for the exercise of your California privacy rights.

Children

The Application is not intended for children under 13 years of age, and we do not knowingly collect Personal Data from children under 13. System Logs & Maintenance

For operation and maintenance purposes, this Application and any third-party services may collect files that record interaction with this Application (system logs) and use other Personal Data (such as the IP Address) for this purpose.

“Do Not Track”

This Application does not support “Do Not Track” requests. To determine whether any of the third-party services it uses honor the “Do Not Track” requests, please read their privacy policies. Changes to This Privacy Policy

We reserve the right to make changes to this privacy notice at any time by giving notice to its Data Subjects on this page and possibly within this Application and/or - as far as technically and legally feasible - sending a notice to Data Subjects via any contact information available to us. Please check this page often, referring to the date of the last modification listed on the top of this page. Should the changes affect processing activities performed on the basis of the Data Subject’s consent, we will collect new consent from the Data Subject, where required, and, if not given, further use of the Application may not be possible.
